Customer Ordering Terms

The terms that apply when a customer places an order through CliqMenu on behalf of a business.

In short

Your purchase contract is with the business, not CliqMenu. Prices and fees are shown before you confirm, and allergen questions go to the business. You cannot cancel an order yourself — contact the business. If you are paying at the counter you can cancel until you pay; once you have paid or the business has accepted your order, there is no refund for a change of mind. If your order is faulty or is not supplied, your consumer-law rights are unaffected.

These Customer Ordering Terms (the "Ordering Terms") apply when you place an order through CliqMenu. They are part of the Terms of Service and should be read with our Privacy Policy. By ticking the acceptance box and placing an order, you agree to these Ordering Terms.

1. CliqMenu is the technology, not the seller

CliqMenu provides the ordering technology. The business you order from (the "Business") is the seller. It owns the menu, sets prices and availability, prepares your food, and is responsible for your order — including its preparation, packaging, pickup timing, and service — and for meeting consumer-law obligations. Your contract of sale is with the Business, not with CliqMenu.

2. Placing an order

  • When you submit an order, you are making an offer to buy the selected items from the Business at the displayed price.
  • The Business may accept, reject, or cancel an order (for example, if an item is unavailable or it is too busy). Order status is shown in the app.
  • Prices shown include taxes where required. Any card or online-payment surcharge and any other fees are shown before you confirm.
  • The Business may limit how many of an item a single order can include.
  • If the Business edits your order with you before accepting it, each item is charged at no more than the price shown when you placed the order.

3. Pickup, pre-orders, and timing

  • Pickup times and any pre-order windows are set by the Business. Times are estimates and may change with demand.
  • Pre-order windows can have limited capacity, an opening time, and a cut-off time — once a window is full or closed, that slot can no longer be booked.
  • Some Businesses accept pre-orders only with online payment.
  • For pre-orders, you may be asked for a phone number or email so the Business can contact you about your order.

4. Payment

  • Where online payment is enabled, your payment is processed by the Business's payment provider (Stripe in Australia and New Zealand; Cashfree in India). CliqMenu does not store your card or bank details.
  • Where payment on collection is offered, you pay the Business directly.
  • If you choose online payment and do not complete it, your order is not confirmed and is automatically cancelled after a short window (about 30 minutes). You can resume payment from the order page within that window.

5. Changes, cancellations, and refunds

You cannot cancel an order yourself. CliqMenu gives you no cancel button and no cancellation window. If you need to cancel or change an order, contact the Business directly — its phone number is shown on your order page — as soon as you can. The Business decides.

Paying at the counter. If you chose to pay when you collect, your order is not paid for and has not been accepted. You can cancel at any time before you pay — just tell the Business's staff. Nothing is charged.

Change of mind. Food is prepared to order. Once you have paid, or once the Business has accepted your order, you are not entitled to cancel it or to a refund because you have changed your mind. The Business may still cancel and refund you, in full or in part, if it chooses to — that is its decision, not a right you can insist on.

Where you pay online, this takes effect the moment your payment succeeds: your order is passed to the Business immediately and preparation begins, and the payment-processing fees charged on your payment are not returned to the Business if the order is later refunded.

Changing your mind is the only thing this rule covers. It does not apply where:

  • your food is faulty, unsafe, not as described, or not of acceptable quality;
  • your order is not supplied, or is not supplied within a reasonable time; or
  • the Business or CliqMenu cancels your order.

Where the Business or CliqMenu cancels a paid order, or the order is not supplied, you get a full refund. That is not something a Business can switch off.

Nothing in these Ordering Terms limits your rights under the Australian Consumer Law, the New Zealand Consumer Guarantees Act 1993, or the Consumer Protection Act, 2019 (India) — including your rights where food is faulty, not as described, or not supplied. Those rights cannot be excluded, and no policy set by a Business overrides them.

Getting a refund. Refunds, replacements, and remedies are handled by the Business. Contact the Business about any issue with your order. CliqMenu can help relay a request but does not control the outcome. Where the Business refunds an online payment, the refund is returned to your original payment method; how quickly it appears depends on your bank or card issuer.

6. Allergens and food information

Allergen notice. Menu descriptions and any allergen or dietary information are provided by the Business, not by CliqMenu. If you have a food allergy or dietary requirement, check directly with the Business before ordering. CliqMenu does not verify this information and is not responsible for it.

7. Your information

To place an order we collect a name (which can be a call-name, not your legal name) and, depending on the order, a phone number and/or email. How we handle this is described in the Privacy Policy. The Business receives the information needed to prepare and hand over your order.

8. Acceptable conduct

You agree not to misuse the ordering service — for example by placing fraudulent orders, abusing staff, or interfering with the Platform. See the Acceptable Use Policy.

9. Liability

To the extent permitted by law, CliqMenu is not liable for the food itself or for the Business's acts or omissions — including the quality, preparation, packaging, timing, or service of your order. Nothing in these Ordering Terms limits any consumer guarantee or right you have that cannot lawfully be excluded. CliqMenu's liability for the ordering technology is limited as set out in the Terms of Service.
